10.9 유럽연합의 자율주행 규제 프레임워크

유럽연합(European Union, EU)의 자율주행 규제는 EU 차원의 형식 승인 체계, 일반 안전 규정, UN/ECE 규정의 인용, 회원국 차원의 도로 운행 규정이 결합된 계층적 구조를 가진다. EU는 사전 승인에 기반한 형식 승인 체계를 채택하므로, 미국의 자체 인증 체계와 구분된다. 이 절에서는 EU 형식 승인 체계, 일반 안전 규정, 자율주행 관련 시행 규정, 데이터 보호와 사생활, 회원국 차원의 규제를 학습 순서에 따라 기술한다.

1. EU 형식 승인 체계

EU의 형식 승인 체계는 Regulation (EU) 2018/858 of the European Parliament and of the Council of 30 May 2018 on the approval and market surveillance of motor vehicles and their trailers, and of systems, components and separate technical units intended for such vehicles에 의하여 시행된다. 이 규정은 이전의 Framework Directive 2007/46/EC를 대체하여 EU 형식 승인의 절차, 시장 감시, 결함 처리, 리콜 절차를 통합적으로 규정한다.

EU 형식 승인은 다음의 절차를 따른다.

  1. 제조사가 형식 승인 신청을 회원국의 형식 승인 기관(approval authority)에 제출한다.
  2. 형식 승인 기관은 기술 시험 기관(technical service)을 지정하여 시험을 수행한다.
  3. 기술 요구사항 적합성이 확인되면 EU 차원의 형식 승인이 발급된다.
  4. 발급된 형식 승인은 EU 전 회원국에 자동적으로 인정된다.
  5. 시장 감시 기관은 시장에 출시된 차량에 대한 사후 감시를 수행한다.

이 절차는 1958 협정에 부속된 UN 규정의 적용과 결합되어 운영된다.

2. 일반 안전 규정 (GSR)

Regulation (EU) 2019/2144 of the European Parliament and of the Council of 27 November 2019 on type-approval requirements for motor vehicles and their trailers, and systems, components and separate technical units intended for such vehicles, as regards their general safety and the protection of vehicle occupants and vulnerable road users는 EU의 일반 안전 규정(General Safety Regulation, GSR)으로서, 차량의 능동·수동 안전 기능에 관한 형식 승인 요건을 규정한다. GSR은 다음과 같은 자율주행 관련 요건을 포함한다.

  • 자동 비상 제동(advanced emergency braking)의 의무화
  • 차로 이탈 경고와 차로 유지 보조의 의무화
  • 사건 데이터 기록 장치(EDR)의 의무화
  • 운전자 졸음·주의 산만 감지의 의무화
  • 사이버 보안과 소프트웨어 갱신 요건의 도입
  • 자동화 차량의 형식 승인 요건의 신설

GSR의 자동화 차량 관련 요건은 시행 규정(implementing regulation)을 통하여 구체화된다.

3. 자동화 차량 시행 규정

Commission Implementing Regulation (EU) 2022/1426 of 5 August 2022 laying down rules for the application of Regulation (EU) 2019/2144 of the European Parliament and of the Council as regards uniform procedures and technical specifications for the type-approval of the automated driving system (ADS) of fully automated vehicles는 완전 자동화 차량의 자동화 운전 시스템(ADS)에 대한 형식 승인 절차와 기술 사양을 규정한다. 이 시행 규정은 다음의 영역을 다룬다.

  • 운용 설계 영역의 명세
  • 동적 운전 작업의 수행
  • 객체 및 사건 검출과 응답
  • 인간-기계 인터페이스
  • 최소 위험 상태와 결함 운용 거동
  • 사이버 보안과 소프트웨어 갱신
  • 사건 데이터 기록과 데이터 저장 시스템
  • 검증과 유효성 확인 절차

이 시행 규정은 EU에서 운전자 없는 자율주행 차량의 형식 승인을 가능하게 하는 학술적·법적 기반을 제공한다.

4. 사이버 보안과 소프트웨어 갱신

EU는 UN R155와 UN R156을 EU 형식 승인의 일부로 직접 채택하고 있다. 따라서 EU에서 형식 승인을 받기 위하여는 사이버 보안 관리 체계(CSMS)와 소프트웨어 갱신 관리 체계(SUMS)의 인증이 요구된다. ISO/SAE 21434와 UN R155 부속서 5는 이러한 인증의 사실상의 기준으로 활용된다.

5. 데이터 보호와 사생활

EU의 데이터 보호는 Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, GDPR)에 의하여 시행된다. GDPR은 자율주행 차량이 수집하는 위치 데이터, 운전 행위 데이터, 차내 영상, 음성과 같은 개인 정보에 대하여 다음의 원칙을 부과한다.

또한 사이버 보안 측면에서는 *Directive (EU) 2022/2555 of the European Parliament and of the Council of 14 December 2022 on measures for a high common level of cybersecurity across the Union (NIS2 Directive)*가 핵심 인프라 운영자에 대한 사이버 보안 의무를 강화하고 있다.

6. 회원국 차원의 규제

EU 형식 승인은 차량의 시장 출시를 가능하게 하지만, 도로 운행에 관한 규정은 회원국의 권한에 속한다. 자율주행 차량의 도로 운행과 관련된 회원국 차원의 규제 사례는 다음과 같다.

6.1 독일

독일은 Gesetz zum autonomen Fahren (자율주행법, 2021)을 제정하여 Level 4 차량의 일반 도로 운행을 허용하는 법적 기반을 마련하였다. 이 법은 차량의 운영 영역(Betriebsbereich)의 사전 승인, 기술 감독자(technische Aufsicht)의 역할, 사고 시의 책임 소재, 데이터 처리에 관한 요건을 규정한다.

6.2 프랑스

프랑스는 자율주행 차량의 도로 운행을 위한 Ordonnance n° 2021-443 du 14 avril 2021 relative au régime de responsabilité pénale applicable en cas de circulation d’un véhicule à délégation de conduite를 제정하여 형사 책임의 분배에 관한 규정을 마련하였다.

6.3 영국

영국은 EU 회원국에서 탈퇴하였으나 EU 규제와 유사한 체계를 유지하면서, Automated and Electric Vehicles Act 2018과 Automated Vehicles Act 2024를 제정하여 자율주행 차량의 책임 분배, 시판 승인, 운영 안전 보증의 법적 기반을 마련하였다.
